Trademarks, Service Marks and the Intellectual Property of Others


Perform[cb] does not allow the use of any trademark, service mark or any other form of intellectual property, including a person’s name, image or likeness, without the authorization of the owner.


  • Examples include, but are not limited to:
    • Images, name or the likeness of Amazon is strictly prohibited
    • Images, name or the likeness of Costco is strictly prohibited
    • Images, name or the likeness of Kohls is strictly prohibited
    • Images, name or the likeness of Bank of New York Mellon is strictly prohibited
    • Images, name or the likeness of Dr. Oz or the 'Dr. Oz Show' is strictly prohibited
    • Images, name or the likeness of Christie Brinkley or Christie Brinkley Authentic Skincare is strictly prohibited
    • Images, name or the likeness of Barbara Corcoran, Mark Cuban, Kevin O'Leary, Lori Greiner, Robert Herjavec, Daymond John, or the 'Shark Tank' show is strictly prohibited
    • Images, name or the likeness of Dr. Joel Schlessinger or LovelySkin,Inc. is strictly prohibited
    • Images, name or the likeness of Holly Madison is strictly prohibited
    • Images, name or the likeness of Lara Spencer is strictly prohibited

A trademark is anything that is used, or intended to be used, to identify the goods of one manufacturer from the goods of others. A service mark is very similar to a trademark, except that it is used to distinguish services. Trademarks and service marks include words, names, symbols and logos. Anything that distinctly identifies a company, brand or product can be a trademark or service mark.


If a trademark owner files a complaint with Perform[cb] about the use of their trademark within a campaign, Perform[cb] will investigate and may enforce certain restrictions on the use of that trademark in a campaign. Perform[cb] may restrict the use of a trademark within a campaign. Ads using restricted trademarks may not be allowed to run.



What happens if I violate this policy?

  • Ad denial: Ads that don't follow this policy may get denied. A denied ad won't be able to run until the policy violation is fixed and the ad is approved.
  • Domain disabling: We may suspend websites that violate this policy, meaning that the website can no longer be advertised with Perform[cb] until the problem is fixed.
  • Account suspension: An account may get suspended if you have several violations or a serious violation. If this happens, all ads in the suspended account will stop running, and we may no longer accept advertising from you. Any related accounts may also get permanently suspended and your new accounts may get automatically suspended at setup.


If you are a trademark owner and feel your trademark is being used in a campaign without your authorization you may submit your complaint by emailing compliance@performcb.com. We encourage you to first contact the marketer or partner directly to resolve the matter, but in the event that no such resolution is possible Perform[cb] will request the appropriate documentation establishing your trademark ownership and promptly make a determination with respect to the Mark in question.
